In these terms and conditions, “Advertiser” means the party who books the space and/or any agent acting on their behalf.
By signing up as an Advertiser you agree to the following Terms & Conditions. You also agree that from time to time we may contact you with updates to these Terms & Conditions and that it is your responsibility to check this page for updates in the event that you do not receive our emails.
The advertiser warrants and represents to the online publisher that...
(1) They have the right to publish the contents of the advertisement, without infringement of any rights of any third party including, without limitation, intellectual property rights.
(2) They have complied with the codes of practice issued by the Advertising Standards Authority in respect of electronic and on-line advertising and all other relevant industry codes of practice.
(3) They will be fully responsible for the terms (including, without limitation, product description, price and compliance with all applicable laws and regulations) of any contract for the sale of goods or services to customers who have seen the advert displayed by the online publisher.
The Advertiser warrants and represents that the advertisement (a) does not contravene any law, statute or regulations in England and/or in any other country where the advertisement might appear as a result of its publication by the Publisher (b) is not in any way defamatory or illegal or an infringement of the rights of any third party (c) complies in all respects with the British Code of Advertising Practice and any other relevant advertising standards prevailing (in England and/or in any other country where the advertisement might appear as a result of its publication by the Publisher) at the time the advertisement is published.
The Advertiser will indemnify and keep the Publisher fully and effectively indemnified from and against any losses, costs and expenses howsoever incurred by the Publisher arising out of or in connection with the advertisement and/or in respect of any breach by the Advertiser of these terms and conditions. The Publisher will consult with the Advertiser as to the way in which any claim against the Publisher (in respect of which indemnity is sought by the Publisher from the Advertiser) is handled.
The Publisher reserves the right (in its absolute discretion) to omit, suspend or exclude an advertisement at any time; any such omission, suspension or exclusion shall be notified to the Advertiser as soon as possible. If the Publisher exercises its rights under this paragraph at any time, the Publisher shall not be liable for costs, claims, liabilities or damages of any kind as a consequence of so doing.
* You are only allowed one account per email. You may have more than one account, for example, for your own customers.
* Unpaid orders older than 10 days will be deleted (just the orders - not your membership!)
* Members can delete their own ads
* Your account will be locked after 5 failed log-in attempts!
* Advertisers without orders who joined more than 10 days ago will have their accounts deleted.
* New Advertisers have to be approved by admin. Ads from unaccepted Advertisers are not displayed.
* If a banner, URL, or alt tag is changed, your ad is disabled until admin reviews & approves these changes.
* Advertisers receive an email when there are only 100 impressions or 25 clicks remaining in their accounts.
* Advertisers receive 25% of money spent by users they refer. This is added directly to their Advertising account.
* Once advertising is purchased there are no cash refunds. Earnings from referrals will be added to Advertisers accounts.
* Positioning of advertisements is at the sole discretion of the online publisher.
* Your Advertiser display & usage statistics are available in your members area
* The statistic for months may be delayed by up to 5 hours
Advertiser acknowledges that Adwebb has not made any guarantees with respect to usage statistics, which include, without limitation, levels of impressions or click-throughs for any advertisement or for any position specified for each advertisement. Adwebb provides the Advertiser with estimated usage statistics only as a courtesy to the Advertiser and Adwebb will not be held liable for any claims relating to any usage statistics however supplied. The Advertiser acknowledges that usage statistics provided by Adwebb are the official, definitive measurements of Adwebb's performance on any delivery obligations provided in the Advertising Order.

In no event shall the liability of the Publisher for any breach of contract or in tort exceed the price paid by the Advertiser for the advertisement.
In no event shall the Publisher have any liability either in contract or in tort for any consequential or indirect loss or damage suffered or incurred by the Advertiser, including (without limitation) loss of profit or damage to reputation or goodwill.
These terms and conditions and all other express terms of the contract shall be governed and construed in accordance with English law and the Advertiser submits to the non-exclusive jurisdiction of the English courts in connection with all disputes, claims or actions arising out of or in connection therewith.
